Mediation process
Insight into working methods and possibilities
After the first contact with you, I will discuss my working method and what the possibilities are.
Intake and appointments
I contact the mediation parties and send them the mediation agreement, the MfN regulations and the MfN rules of conduct. During the first meeting, I will start by going through and signing the mediation agreement after which the mediation starts.
Explore and provide insight
Most mediation meetings take place with all parties at the same time. If necessary, I speak to a party separately. In a conflict, there are usually images of the other person or of the situation and there are misunderstandings. These misunderstandings are brought to the table during the mediation talks. Emotions can sometimes run high, but I still make sure that the conversation does not degenerate into arguments. I make sure that you both really say what you are concerned about and that you both understand what the other means.
Mapping solutions
Then the time comes to look for a solution. My job is to ensure that you both take the time to think carefully in order to arrive at a well-considered solution. I will not give any advice myself. However, I can provide neutral information during the mediation. If necessary, you can consult an advisor, such as an accountant, lawyer or tax specialist.
Evaluation and future
The mediation is concluded with a signed settlement agreement in which the agreements are laid down on how the parties will proceed in the future.
Advantages of mediation
- Working towards an alternative, often "win-win" solution
- Stay away from a battle model and opt for a solution
- Benefiting from the operation of the mediation agreement (secrecy and confidentiality)
- Mediating by a 'safe', neutral and non-emotional third party (mediator) during the mediation process
- Get clarity faster and cheaper
- Avoiding the unnecessary burden of a procedure
- Keeping control until an acceptable solution is reached
